Refund Policy
When Guard.ch refunds a payment, what cancelling does, and how to withdraw from a contract.
1. Introduction
This Refund Policy explains when Guard.ch, operated by Zesiger.net, refunds payments. It forms part of the Terms of Service, and capitalised terms have the meanings given there. Guard.ch sells the subscription Business, billed monthly or annually through Stripe; Enterprise and other contracts agreed individually with our sales team follow their order form.
2. Free start and trial
The free start costs nothing and needs no payment method. Paid plans begin with a 30-day trial where section 10 of the Terms provides it: cancelling during the trial is free, and nothing is charged. Beyond the trial and the cases in this policy, Guard.ch offers no money-back guarantee.
3. Renewals and cancellation
Subscriptions renew automatically until cancelled. You can cancel at any time in the billing area of the dashboard. The cancellation takes effect at the end of the paid period: you keep access until then, and nothing is refunded for the rest of that period, except in the cases in sections 4 and 5 or where mandatory law provides otherwise.
A move to a larger plan, more seats or annual billing applies at once and is charged pro rata for the rest of the period. A move to fewer seats, a smaller plan or monthly billing takes effect at the end of the paid period; nothing is credited for the running period.
4. When we refund
- Duplicate or wrong charges. If you were charged twice for the same period or charged incorrectly because of an error on our side, we refund the duplicate or incorrect amount in full.
- Material changes. If you terminate because of a material change to the Terms or the Service (section 22 of the Terms), or object to a new subprocessor and no alternative can be agreed, we refund the prepaid fees for the unused part of the period pro rata.
- Force majeure. If an event beyond our control prevents material performance for more than 30 consecutive days and the Subscription Term is terminated, we refund the prepaid fees for the unused part pro rata (section 21 of the Terms).
- Extended unavailability. For extended unavailability of the Service we may issue credits or refunds at our discretion (section 11 of the Terms).
5. Consumer right of withdrawal
If you are a Consumer in the EEA or the United Kingdom, you may withdraw from the contract within 14 days without giving a reason. Use Withdraw from a contract in the site footer, or write to legal@guard.ch saying that you withdraw; section 10 of the Terms contains the model withdrawal form. We confirm every withdrawal by email with the date and time we received it.
If you withdraw, we refund the payments received under that contract within 14 days of receiving your withdrawal. Where you expressly asked for the paid Service to begin during the withdrawal period, we may keep a proportionate amount for the service already provided, as permitted by applicable law.
Swiss law provides no general right of withdrawal for contracts concluded online. Your other statutory rights, including warranty rights, remain unaffected.
6. How refunds are made
- Ask for a refund at legal@guard.ch from the email address of your account, with the date of the charge. No form is needed.
- Refunds are paid to the original payment method through Stripe, in the currency of the charge. Depending on your bank, the amount can take several business days to appear.
- A full refund of a subscription payment ends that subscription at once, together with the access it granted. Other plans and your account remain.
7. Chargebacks
Please contact us before disputing a charge with your bank or card issuer; most questions are solved faster by email, and a duplicate or wrong charge is refunded in full (section 4). A chargeback or payment dispute ends the subscription it concerns at once and always leads to the suspension of your account.
8. Changes to this policy
We may update this Refund Policy. Material changes are announced to active subscribers at least 30 days before they take effect. A change never affects a refund request for a charge made before the change took effect.
